. approval of the special use district violates the conformity requirement of state law. the proposal to adopt the so-called special use district, the one parcel of land is for the express purpose which is to grant the owner an exemption from numerous zoning rules is in essence a variance. as such, the city must comply with the procedures and make the substantive findings required by state and city law for approving a variance, which this proposal fails to do. the pagoda theater site is obviously much better than the columbus avenue extraction. we have worked and supported. our neighborhood merchants and neighbors not disrupting the business community for over a year or two. we also have a strong feeling that the pagoda site's $9 million expenditure to extract tbms which have salvage value at most 4.4 to $6 million is illogical. by not even extracting the machines at the pagoda, by varying the machines as has been done in new york city, in brisbane, australia, in the tunnel in the english channel, where machines are either lowered below tunnels or shifted to the side or [speaker not u

a future of a north beach station. that's not what's before us. but this project allows that as a realistic possibility. and one of my oppositions or my questioning of the central subway when it first came forward was ending the subway in chinatown. i know that was what was funded and that was what was analyzed and that's what it had to be. but i was really happy to hear even in those days that the extension of the tunnel was proposed to go into north beach and that's, you know, makes a lot of sense. and i've heard that it can be done. the other issue that's been brought up is the height of the new structure which is exactly the same as the height of the existing structure. if you're happy with the height of the existing structure, then i don't really know why someone would object to the very same building at the same height and whether we have to go through the same mechanics again to approve the same thing. and that's maybe one reason why it takes so long to do anything in san francisco, because we like to do it 10 times before we approve it. but it makes sense you're building essentially

use and rezonings. that didn't prove to be economically feasible. silver leathers came before the commission. however, this is the first one by mr. campos, my client, and i was at the commission in 2009 when you approved this 6 to 1 with dozens of community members supporting it in 2009. unfortunately, as you know in that period, the econ kind of fell apart and financing and so did equity. and when you approved, it was not a good time to get financing and start construction. * economy now the aloe am -- economy has come back, lending is available. the client is ready to go forward and start with all the final permitting when the city claim to the client a few months ago and asked that his construction be delayed by reason of using the site for up to two years for removing the boring equipment. and since then my client has agreed to delay his construction. and there are some risks. however, it seems like it's what's best for the city and the neighborhood, and was willing to come back before you and is today on essentially the same project. but instead of a demolition -- excus

you for listening to all of us. i'm lori thomas, the owner at 532 columbus, which is right on the block before columbus and union. i just wanted to reiterate what i have already told a lot of folks here and director reiskin, which is this is a difficult situation and i think the pagoda palace is the best alternative, as well as i can understand to minimize the disruption in north beach. during the period full time from august to the end of, nor when we had the utility work going forward, our monday to friday lunch sales dropped 25%. i would recommend that the city and mta consider some sort of rent credit for the co-located businesses, certainly on that specific block, perhaps. because it's hard to project all of the influences that affect drops in revenue; right? so i do want to say that i appreciate all the work that everybody has done to try to come up with a solution and if we have to bring the devices up in north beach, i think the pagoda theater offers the best alternative that i am aware of right now. but i do want to speak as a business owner and recognize that i'm

. the tunnel-boring machinery is just a ruse to use funds to extend the subway beyond its federally -- it's otherwise federally-funded boundaries. the november, 2008 federal document approving this explicitly lists a temporary tunnel for the extraction of the tunnel-boring machines and thus if there are no tunnel-boring machines there will be no tunneling into north beach. however, the city wants to tunnel into northern beach to get a start on the subway that will extend further. this is fine if it would properly plan. i am aware there has been no proper planning on the extension of the subway beyond chinatown, no community meetings on what path it should take and how it would be used. we are starting to build for a future subway without the careful study and approval of what we are going to do. we need a plan before we start digging. so i suggest that somehow we take another look. your job as the planning commission is to take another look at the longer term plan here and ask do we really know what we're doing for long-term subway construction? >> thank you, next speaker. >> good aft

promoter and resulted in a large scale, i don't want to use the rword. but fight. inside and outside of the venue, a blockage of the street and additional units had to be called in to clear the area. northern station and the staff met with yoshi last week and there is new conditions put on the permit and they fully understand the mistakes that they had made at that point and moving forward with us in the much better, i think, communication and better operational policies on their end. as you probably have been hearing in the news, there is also an incident this week on broad way which is a large-scale fight that really centered around the large parking lot that is on broad way that is used by the people in the area also spilled into the street and officer methias is here from central and he will give you guys a little bit more detail on that. but that is also very recent in this last weekend and we are still doing the investigation on our end and central station as well. we are out there gathering the facts and moving forward to really see what happened exactly. moving forward, there

we can make that better. they have significantly improved the lighting it used to be a dim lit area and now it is really bright. there is some surveillance cameras there, we are going to be talking with them as far as what kind of staffing they had and then also one of the problems we were dealing with is the cars being able to leave in a timely manner and it is kind of a rubix cube if you have all of these cars tucked in there where you have to get one and there is one in the back and you have to move all of these cars and that could create an issue. that is one thing that we are going to deal with the permit bureau and the loss to see the best fit for everybody. any questions or comments? >> i have a couple of questions. >> so, with regard to the parking lot, the loitering ordinance, the parking lot attendance in that lot are not security. they are parking lot attendants? >> correct. >> if someone is loitering they don't call the police? >> it would not come under the legislation as far as loitering near a nightclub however what they will be able to do it is private property and s

it was continue to february 25th. this week at the land-use committee hearing they had the car sharing parking ordinance sponsored by supervisor wiener. he wanted to allow south side spaces such as parking lots that had been in place for at least a year, they wanted the same number of spaces. he wanted to cap the maximum for residential and commercial buildings, and requiring signage for the spaces. he wanted to ensure that these spaces will be allowed for projects not seeking a cu. wanted to provide the planning department with more enforcement excitation power. -- -- our department has been asked to develop the signage requirement for the car share spaces. there were three speakers in opposition and one speaker in support. board president chu expressed concern over enforcement but stated enthusiasm for the potential development of new enforcement measures. it was recommended for approval by the full board. we have a host of new ordinances and hearing requests. first for the commission and the historic reservation commission supervisor wiener has introudced a version of the
